Article 1. Definitions
In these terms and conditions, the following terms shall have the following meanings:
VMfysio:
VMfysio, located at AJ Ernststraat 599 (1082 LD) in Amsterdam, registered with the Chamber of Commerce under number 34336697 and legally represented by Messrs. M. Melief and R. Vlek.
Participant:
Natural person, in the capacity of consumer, who enters into an agreement with VMfysio to engage in sports and exercise activities.
Parties:
VMphysio and the participant jointly.
Location:
A training location agreed upon between VMfysio and the participant.
Agreement:
The agreement based on these general terms and conditions in which the participant and VMfysio set forth in writing the activities VMfysio will provide to the participant.
Activities:
Including – but not limited to – personal physical therapy training, group training, circuit training, fitness and vitality.

Payment:
Payment method via direct debit, cash or debit card, with final options at the front desk.
Article 2. General
2.1 These general conditions apply to all sports classes and activities organized by VMfysio.
2.2 By participating in our sports classes and physiofitness activities, you agree to these general conditions.
Article 3. Membership
3.1 Membership with VMfysio is personal and non-transferable.
3.2 Enrollment is via the enrollment form at the front desk of the practice or with one of the physiotherapists.
3.3 Membership can be applied for at any time, subject to availability.
3.4 Membership is subject to payment of the agreed membership fee.
3.5 The minimum age for membership is 18 years, unless otherwise agreed with VMfysio.
Article 4. Liability
4.1 The physical therapy practice is not liable for any injury, loss or damage to members’ personal property.
4.2 Members are advised to have their own health insurance to cover any injuries or medical expenses.
4.3 It is the responsibility of members to assess their own physical condition and health before using the facilities. If in doubt, it is advisable to consult a doctor beforehand.
4.4 VMfysio will not be liable in cases of force majeure. Force majeure means everything that is understood by it in law and jurisprudence. VMfysio will not be bound by its obligations under the agreement if performance has become impossible due to force majeure.
4.5 If a force majeure situation lasts longer than 14 calendar days, both parties will have the right to dissolve the agreement.
Article 5. Payments
5.1 Payment of membership fees must be made according to the agreed payment terms. Payment can be made by bank transfer, pin payment or cash.
5.2 Late payment may result in denial of access to VMfysio.
5.3 Any administrative or collection costs arising from late payment will be the responsibility of the member.
Article 6. Termination of membership
6.1 Membership may be terminated by giving written notice to the physical therapist, subject to a notice period of 1 month.
6.2 In case of repeated violation of the general conditions or causing a nuisance, the physical therapist reserves the right to terminate the membership immediately.
6.3 In case of premature termination of the membership, a refund of the membership fee is not possible.
Article 7. Privacy
7.1 Personal data of members will be kept confidential and used only for administrative purposes and communication with members.
7.2 The physical therapy practice takes appropriate measures to ensure the privacy and security of personal data, in accordance with applicable laws and regulations.
Article 8. Changes and additions
8.1 VMfysio reserves the right to amend or supplement these general terms and conditions. Members will be informed in a timely manner.
8.2 VMfysio reserves the right to change opening hours, facilities and rates. Such changes will be communicated in a timely manner.
8.3 In case of cancellation of a group lesson or activity by VMfysio, an attempt will be made to offer a suitable alternative.
House Rules
1. Membership and Registration
1.1 All members must register and have a valid membership in order to participate in sports classes, with the exception of the free trial class.
2. Respect and Courtesy
2.1 Treat all staff and fellow members with respect and kindness.
2.2 Do not use offensive, discriminatory or threatening language or behavior.
3. Hygiene
3.1 Always wear appropriate sportswear.
5. Safety
5.1 Always follow the instructions of trainers and staff.
5.2 Consider the safety of others while training and avoid reckless behavior.
5.3 Report unsafe situations or injuries to staff immediately.
6. Personal Property
6.1 VMphysio is not responsible for loss, theft or damage to personal property. Take good care of your own belongings and keep them safe.
7. Class schedules and reservations
7.1 If you are unable to attend, cancel your appointment by calling VMfysio at 020-6618378 or leaving a message on the answering machine. You may also cancel your appointment at info@vmfysio.nl.
7.2 Arrive on time for scheduled classes and cancel in a timely manner if you are unable to attend so that other members have the opportunity to participate.
7.3 Changes to the class schedule will be communicated in advance.
8. No nuisance
8.1 Do not make excessive noise that may disturb other members.
8.2 Do not use telephones or other devices in a way that disturbs others.
9. Alcohol and Drugs
9.1 Consumption of alcohol or drugs is strictly prohibited during our classes.
10. Compliance
10.1 Failure to comply with house rules may result in warnings, suspension or termination of membership.
